General Terms and Conditions of FitSole
Welcome to FitSole! These general terms and conditions (hereinafter referred to as "Terms") apply to all orders, deliveries, and services offered by FitSole, registered in the Netherlands under Chamber of Commerce number 95396446, with VAT number NL867114265B01. By using our website and purchasing products from us, you agree to these terms. Please read them carefully before placing an order.
1. General
1.1 These terms apply to every offer from FitSole and to every agreement made between FitSole and the customer (hereinafter referred to as the "buyer").
1.2 Deviations from these terms are only valid if agreed upon in writing.
1.3 By placing an order with FitSole, the buyer agrees to the delivery and payment terms.
2. Products
2.1 FitSole provides sports insoles and accessories designed for optimal comfort and support during athletic activities. Our products are manufactured according to high quality and sustainability standards.
2.2 The specifications, sizes, colors, and other product details are carefully described on the website. However, minor deviations may occur, and FitSole reserves the right to make minor adjustments without prior notice that do not affect the functionality of the product.
2.3 All images, descriptions, and colors on the website are for illustration purposes. The actual products may differ slightly, depending on screen settings and product variations.
3. Orders and Agreement
3.1 An agreement is concluded at the moment the buyer places an order via our website and FitSole confirms this order by email.
3.2 FitSole reserves the right to refuse orders or request additional information before an order is accepted.
3.3 If FitSole cannot fulfill the order, for example due to sold-out products or delivery issues, FitSole will inform the buyer as soon as possible and refund the amount paid.
4. Prices and Payment
4.1 All prices on the website are in euros and include VAT, unless otherwise stated.
4.2 Shipping costs are stated separately during the ordering process and depend on the delivery address and the size of the order.
4.3 Payments can be made via the payment methods indicated on the website. The order will only be processed after the payment has been successfully completed.
4.4 FitSole reserves the right to change prices and offers at any time. The price applicable at the time of ordering is the price charged.
5. Delivery
5.1 FitSole aims to deliver orders within the specified delivery time. Exceeding the delivery time does not entitle the buyer to compensation or cancellation of the agreement, unless otherwise agreed in writing.
5.2 Deliveries are made to the address provided by the buyer. It is the buyer's responsibility to provide a correct and complete delivery address.
5.3 If delivery of an ordered product proves impossible, for example because the product is out of stock, FitSole will inform the buyer as soon as possible and refund the amount paid.
6. Returns and Right of Withdrawal
6.1 The buyer has the right to withdraw from the purchase agreement within 30 days of receiving the products without giving any reason, provided the buyer is a consumer.
6.2 For business customers, orders cannot be returned and the right of withdrawal does not apply.
6.3 The costs for return shipping are the responsibility of the buyer, unless otherwise agreed.
6.4 To exercise the right of withdrawal, the buyer must inform FitSole of the decision to withdraw from the agreement via an unambiguous statement by email or in writing.
6.5 Returns are only accepted if the products are returned in their original condition, undamaged, and in the original packaging. In the case of a correct return, FitSole will refund the full purchase amount within 14 days after receiving the return.
6.6 Personalized products or products that are custom-made cannot be returned unless there is a manufacturing defect.
7. Warranty and Liability
7.1 FitSole guarantees that the delivered products meet the usual requirements and standards that can reasonably be expected of the product.
7.2 The warranty does not apply to damage caused by improper use, incorrect maintenance, or use that deviates from the instructions provided by FitSole.
7.3 FitSole is not liable for damage resulting from improper use of the products.
7.4 In the case of a defective product covered by the warranty, FitSole will offer free repair or replacement. If repair or replacement is not possible, the purchase amount will be refunded.
8. Privacy and Data Protection
8.1 FitSole places great importance on the protection of personal data. All personal data is processed in accordance with applicable privacy legislation.

9. Force Majeure
9.1 FitSole is not liable for delays or failure to meet obligations under the agreement if this is the result of force majeure. Force majeure includes, among other things: natural disasters, strikes, government measures, transport problems, pandemics, or technical failures.
9.2 In the event of force majeure, FitSole has the right to suspend or cancel the agreement without being liable for any form of compensation.
10. Applicable Law and Disputes
10.1 Dutch law applies to all agreements and transactions with FitSole.
10.2 In the event of disputes arising from the agreement, the parties will attempt to reach a solution through mutual consultation. If this is not successful, disputes will be submitted to the competent court in the district where FitSole is located.
